The Birmingham Law Society’s Dispute Resolution Committee has responded to the Ministry of Justice (MoJ) consultation on post-EU reforms for British Courts. The MoJ seeks views from the profession as to whether the power to depart from retained EU case law should be extended from the Supreme Court to either: (a) the Court of Appeal (and equivalent Scottish and Northern Ireland courts); or (b): the Court of Appeal and the High Court (and equivalent Scottish and Northern Ireland courts).
