Contentious Probate Case Law Update

A recent case law update on probate and trusts, primarily aimed at non-litigators.  The seminar will review the most common types of contentious probate disputes and provide an update on the many and interesting cases from the last 12-18 months, in particular:


  • 1975 Act claims

  • Construction/rectification claims

  • Estate administration disputes

  • Capacity disputes

  • Knowledge and approval cases

  • Proprietary Estoppel


The Presenters: Presented by Max Orbach and Robert Hill of Freeths LLP.  Freeths have a large Private Client Dispute Resolution team that specialises in contested probate and trusts, ‘lifetime disputes’, (including litigation in the Court of Protection) disputes concerning the beneficial ownership of property and independent estate administration. Members of the team are based in the firm’s Birmingham, Bristol, Nottingham, Oxford and Leeds offices.

They will be joined by Louise Levene who is International Asset Services Manager at Finders International. The talk will comprise a refresher on the full range of Finders’ services, with an emphasis on our genealogy work, risks and due diligence for estate practitioners; our missing beneficiary and missing Will indemnity insurance and related work. We will also talk about our international asset service and the issues that arise most frequently for busy practitioners, such as US shares requiring Medallion Guarantee stamps; and the closure of foreign bank accounts.

Louise joined the Finders team in January 2015 and brings nineteen years’ experience in the field of probate genealogy and probate support services to her role. With specialist expertise in the particular field of recovering international assets, she has completed a very wide variety of asset-related work for hundreds of estates, from selling shares in the USA and Australia, to closing bank and investment accounts around the world, to obtaining Grants offshore, resealing in Commonwealth jurisdictions, and working persistently and patiently through the red tape everywhere. Louise has built up considerable practical know-how based on her experiences, and she enjoys using this knowledge to navigate the often opaque world of transfer agents and foreign financial institutions, taking a practical, problem-solving approach to help estate administrators cut through the bureaucracy that delays the winding up of worldwide estates.
