RESTRICTIVE AND POSITIVE COVENANTS IN FREEHOLD LAND - 22nd January 2020

Both restrictive and positive covenants are frequently met: over 70% of all freehold titles being subject to the former. Many such covenants are unenforceable but nevertheless provide a rich source of income for the insurers. The course aims to look at the enforceability of such covenants. In addition estate rent charges are becoming a major issue.Topics covered include:
• Enforceability of restrictive covenants
• Interpretation of restrictive covenants
• When to advise and when to insure
• Enforceability of positive covenants
• Unadopted roads and their maintenance
• Flying freeholds
• Estate rent charges in freehold land
